GENERAL CONDITIONS OF CONTRACT
1.- Legal conditions for purchasing at FICOSTERRA ONLINE
These legal contracting conditions regulate the use of the online store of the website www.ficosterra.com, of which it is legal responsible FICOSTERRA, S.L., hereinafter, FICOSTERRA.

Thus, the main purpose of these General Contract Conditions is to regulate the information provided in the FICOSTERRA online store, the purchase of the products offered therein and the commercial transactions that arise between FICOSTERRA and the CLIENT.</p >
Both browsing the FICOSTERRA online store and purchasing the products offered therein imply acceptance as a CUSTOMER of these General Contract Conditions.
3.- Purchase process
To make a purchase at www.ficosterra.com you must follow the following process:
- You must select the products you wish to purchase from the website. The products offered by FICOSTERRA on its website indicate the sale price in euros and include Value Added Tax (VAT), as well as shipping costs, provided that the shipment is made to a location within mainland Spain. In those cases in which the destination of the shipment is located outside said geographical area, the provisions of clause 5 (“Shipping”) must be followed.
- Once you have selected the product you wish to purchase, you must press the “Add to cart” button. In this way, the desired product will be incorporated into your virtual shopping cart.
- Once you have selected the products you wish to purchase and these have been included in the virtual cart, which will show a summary with the selected products, in order to finalize the purchase, you must press the “Checkout” button.
- Subsequently, you can choose between making a purchase as a guest user, without having to register, or as a registered user, creating a private user profile for this purpose. In any case, you must include the personal data that FICOSTERRA requests so that it can send the products to the place that you indicate and, later, you must proceed to pay for the order by credit or debit card.
- In the event that you wish to request the invoice for the order, you must include your tax information so that FICOSTERRA will send you an email in which your invoice will be attached. - Similarly, if after processing your order you realize that you have made a mistake when providing your personal data during the aforementioned procedure, you must notify FICOSTERRA by phone 910 100 505 or by email email@example.com.
The web page www.ficosterra.com aims to show in a precise and real way the technical and aesthetic characteristics of the products, being responsible for the reliability, veracity and accuracy of the content, data or information regarding the products offered. However, and with respect to the images included on the website, it must be taken into account that it is possible that there are differences between the appreciation of the online product and the physical product.
You can only purchase the FICOSTERRA products offered on its website by using a credit or debit card as a payment method
Payment by credit card used in FICOSTERRA is made through the redsys secure payment gateway.
Through this payment method, FICOSTERRA never processes any CUSTOMER data related to their card number or bank account. All the CLIENT’s bank details are managed directly through the virtual payment gateway, which meets all the required security conditions and guarantees the security of the data provided by the CLIENT, so that FICOSTERRA always can offer the greatest transparency and confidentiality in the transaction. Thus, all operations that involve the transmission of personal or banking data are carried out using a secure environment.
Payment is accepted with any credit or debit card supported by the Redsys system.

The order will be delivered to the address indicated by the CLIENT in the purchase process included in the third section, “purchase process” within an approximate period of between 1 and 5 calendar days, depending of the available stock, as well as the destination location. In shipments made to locations outside the peninsula, the delivery time may be longer.
FICOSTERRA does not assume any responsibility in those cases in which the delivery of the order could not be made as a result of the inaccuracy of the delivery data provided by the CLIENT or when the delivery cannot be carried out for reasons that are not may be attributable to the company that transports the product, assigned for this purpose, such as the absence of the recipient after several delivery attempts.
Shipping costs to the peninsula are included in the price of the products.
In those orders made to locations outside the peninsular national territory, the price of the product may be increased by virtue of the shipping costs assumed by FICOSTERRA, informing the CLIENT of the amount thereof prior to the completion of the procedure of the purchase and after requesting a shipping estimate with the transport company that is designated by FICOSTERRA.
Only exchanges or returns will be accepted due to product manufacturing defects or merchandise in poor condition. The CLIENT is requested that in relation to the products that he is going to return due to defects or being in poor condition, to avoid transport problems, make sure that the product is correctly protected, sending it to the following address:</p >

Once FICOSTERRA has received it, it will proceed to check its status and verify the veracity of the claim that led to the return of the product by the CLIENT.
Subsequently, when FICOSTERRA has verified that there were manufacturing defects or that the product was in poor condition and that these conditions of the product were not due to its misuse by the CLIENT, it will proceed to the return of the money paid for the products purchased by the same payment system used for the transaction or when sending a product with the same characteristics.
In those cases in which the CLIENT has purchased several products in the same order, he may make a partial return, so that he may return only one of them, keeping the rest, provided that it had manufacturing defects or was in poor condition.
FICOSTERRA will assume the transportation costs of the products returned due to manufacturing defects or because they are in poor condition, as long as these conditions of the product are not due to misuse by the CLIENT.
If your order is damaged during transport, the CLIENT must not open it, and will inform FICOSTERRA of this circumstance the same day it is received, by calling 910 100 505 or by sending an email to email@example.com. In the same way, we ask the CUSTOMER to state this when signing the delivery note.
Right of withdrawal
According to the provisions of Law 3/2014, of March 27, which modifies the revised text of the General Law for the Defense of Consumers and Users, the right of withdrawal will not be applicable to those contracts referring to supplies of goods made according to the consumer’s specifications or clearly personalized, or that, by their nature, cannot be returned or can deteriorate or expire quickly or that are sealed and are not suitable for return for reasons of health protection or hygiene and that have been unsealed after delivery.
Notwithstanding, the right of withdrawal will be applicable in the event of supplies of products that do not meet the characteristics listed in the previous paragraph. In this way, the CLIENT could desist from the purchase of the product during the 14 days following the delivery of the order, without the need to indicate any reason. As a consequence of this, the price of the withdrawn products would be refunded once the aforementioned products had been received and within a maximum period of 14 days from the date on which the CLIENT informed of said withdrawal, the CLIENT assuming both the return cost as the expenses incurred by FICOSTERRA for the shipment of the product. The refund of the money paid would be made by the same payment system used for the transaction.

Furthermore, FICOSTERRA has an after-sales service, through which the client can submit queries by email to firstname.lastname@example.org or to through the customer service phone.
Unless there is evidence to the contrary, it will be understood that the products are in accordance with the contract as long as they meet all the requirements stated below:
a) They conform to the description made by the seller and possess the qualities of the product that the seller has presented to the consumer and user in the form of a sample or model.
b) They are suitable for the uses to which products of the same type are ordinarily used.
c) They are suitable for any special use required by the consumer and user when they have informed the seller at the time of signing the contract, provided that the latter has admitted that the product is suitable for said use
d) Present the usual quality and benefits of a product of the same type that the consumer and user can reasonably expect, taking into account the nature of the product.
If the customer wishes to file a claim, they must do so via email email@example.com. The term to answer said claim will be 24/48 working hours.
9.- Protection of personal data
The personal data collected in the online purchase process regulated in the third section of these General Contract Conditions will be processed by FICOSTERRA in order to process, send and bill the products purchased by the CLIENT, as well as to send them commercial information on new offers and products of FICOSTERRA based on the legitimate interest of the Company.
Only the data that is necessary for its shipment will be communicated to the company in charge of transporting the products. Your data will not be transferred to any other third party, except legal obligation.
In order to place orders in the FICOSTERRA online store, as well as to be able to request the desired invoice, the CLIENT will provide, voluntarily and under his responsibility, his personal data, which must be true and exact.
